What Injured Albertan's say about WCB

Some posted their names others wish to remain anonymous due to fear of repercussions by the Workers Compensation Board of Alberta.Comments of Injured workers and Advocates.These comments were copied from http://www.gopetition.com/petitions/remove-queens-bench-status-from-workers-compensation-boards-court/signatures-page2.html and also from http://www.gopetition.com/online/19942/signatures-page1.html as there are also many other comments from across Canada.However the story is the same all across this nation, corruption and deceit, abuse of power and abuse of the injured just to make the lives of those that work for the Workers Compensation Boards all that mush more pleasurable while the injured of who this organization was created for are forced into poverty,loss of property, loss of families and in some cases loss of life.

Brent McGillis Edmonton,Alberta ; Citizens in Canada who are above the Law. How come there is not a Class Action Lawyer in Toronto that can sue these guys under the Charter of Rights and Freedoms? It says explicitly in the charter that we as a group of disabled persons may not be discriminated against. The gov't has stripped an entire class of citizens of there human rights, because we are gimps? Are there any lawyers listening?

Robert Weiss Wetaskiwin,Alberta ; The WCB should not be allowed to treat people like garbage. The WCB takes away our human rights, dignity and self-respect among other things to the point we have nothing left. It has cost some people their lives. The WCB is allowed to hide behind the flawed policies that allows them to do what they want when they want and how they want, even if it costs the injured worker their life. Time the government that represents the tax paying citizens that built this country do something about it.

Ken Balacko Calgary,Alberta ;I was forced to work, under threats of being dismissed, to sit near toxic gases (coal methane gas and brake fluid toxic solvents) and hospitalized after but in spite of emergency doctors requests for WCB to have an investigation and poison control and Occupational Health and Safety to investigate, WCB refused to admit the incident took place. Ten of my co-workers wittnessed this act but the companies involved can't be sued and are protected by the WCB Act.

Daniel Hunter Edmonton,Alberta ; The creation of a court to police the actions of the business it is a part of is ridiculous. Even worse is to staff it with political appointees selected to favor the business itself. WCB Alberta tribunals are a farce and nothing more than a kangaroo court.
When their decisions are appealed to a real court with a real judge all he can do is refer it back to them.
A standard catch 22.It has to be changed.

Sabina Cincer Calgary,AB ; For almost 10 years I have had ailments, which have stemmed from a fall that occurred on my employer’s premises. I received WCB compensation until Sep.99. An “independent WCB doctor had declared me as healthy.
My symptoms, back pain and leg giving out, hadn’t changed. In 2000 I had a complicated elbow fracture. On year later WCB reopened my file. At some point WCB forced me to give up Physio and despite my surgeon’s order to start a program at their Rehab Centre where I have caught RSD.

Monique Ceresney Delburne,AB ; The WCB is not performing as it was set up to do. It is neccessary to re-evaluate how the decision-making is performed, whether it REALLY protects workers and ensures thier safety and most importantly whether it helps injured workers in a non-adversarial way. Workers should have more options if they feel the board's decisions are not balanced and fair.

Joan Standish Red Deer,Alberta ; WCB needs a complete overhaul. This organization is extremely corrupt. The injured workers of Alberta need to be dealt with fairly, honestly and quickly, with out the interference of the stakeholders(employers). The stakeholders and the case managers are worried about the dollar they may be assessed or the money they won't receive in bonuses for getting injured workers off the benefits they are legally entitled to.

Norman Standish Sr. Red Deer,Alberta ; We have been representing injured workers since 1992 and a complete overhaul of this system is definitely required. We need to stop the corruption that exists. Many injured workers are left with no recourse after they are denied their rightful benefits. More weight and evidence is given to the employers (shareholders) and the WCB own paid doctors than the family physicians, and specialists that the family doctors send the injured workers to.

The workers compensation board should be abolished. Alberta Health care already foots the bill for our medical even though WCB has collected premiums on our behalf for years.

Further, Their use of psuedo professionals to write fictional options to support WCB policies is a clear case of malpractice. This should not be tolerate is a society of law. If a government created agency openly advocates malpractice, It is an in tolerable situation. You can't fight the government and win.......

After reading many of the worker's comments on this site, I am that much more disheartened and depressed in the thinking, I am NEVER going to get the assistance I require in getting back to workable condition. I am working right now, but I am injured and cannot get the help I need. They just keep closing my file.

Barry Duxbury Calgary Ab ; I have inoperable back pain due to two work related injuries. WCB accepted responsbility at the beginning but as soon as it became apperant that the two sugeries I had only increased the problem, WCB dropped my claim like a hot potato. I have been fighting them for over 20 years with no results. I have lost everything-my home, my savings,my self respect because I am unable to work. My wife has supported myself and my children until she has succombed to a life threatening disease and cannot work.

Edmonton,Alberta ; I have occipital neuralgia from a slip and fall injury and W.C.B. decided to cut off my benefits and medications which I need and cannot afford. I am appalled at their systematic abuse they give to injured workers and this MUST STOP!!!!!

It is about time that the gov't that we elected stand up and do what they said they would do and investigate and get WCB on the right track to truly helping the people they were meant to help. Where is this money going as it is not going to my husband NOR any other injured workers?? Companies should also be asking this question along with every person that will or does collect CPP! Travis Short Calgary,Alberta ; I fell 22 meters from a drilling rig derrick in the winter of 2001, suffering severe multiple injuries, including a brain injury, which WCB claims has "resolved it self" and is therefore no longer a valid part of claim, my left knee needs to be replaced,, but since I am only 40, I have to wait until I am 55 to get it replaced, in the meantime I get by on 150 40 mg tablets of oxycontin a month. I was also forced to return to work, further aggravating my injuries and pain threshold. Suicide?

James Wonnacott Calgary Alberta ; My brother has been suffering from an injury for over 2 years now from using faulty equipment while working for the company Tesla. His arm is now immobilized. WCB hasn't helped him one bit but rather has given him great grief. WCB is full of crooked liars, people with large wallets but little concern for human decency. It's time to end the madness.

Everyone who is injured at work should have the right to continue to live in the same manner prior to the accident, not in poverty. That is what this insurance is supposed to be for.

Gene Ostrowski Seven Persons,Alberta ; I am one of the cases that cannot work as per various Doctor's reports and Worker's Compensation pays me 800 Dollars a month when I was making over 5000 Dollars a month when I was injured in 2003 and they expect me to live on this. What a big cutback on wages and they feel this is fair. How is it the Doctors reports are ignored and case workers with no medical training can deem me fit enough to work in order to cut back on paying us what is due to us.

Nora Yaghi Edmonton,AB ; I was injured at age 23 and now for the rest of my life I have to live with an injury that restricts me everyday even thought it's not as visible as others injuries. The WCB says my lifetime compensation amount is a percentage of $70,000 depending on how they measure it. Keep in mind they can't measure chronic pain and severe depression.

Earl Forrest Edmonton,Alberta ; I have been treated unjustly by WCB on two different claims an injury claim and a progressive injury claim. Both times I was denied they came up with a reason that made no sense. It is a very stressful thing to go through, and we all as workers should have an organization to trust in if we are injured at work. WCB needs to change and start doing what there name says. Compensating!!!!!!

Monica Weiss Red Deer,AB ; My husband is currently a victim of the WCB's shenanigans... he is facing a condition caused by his injury that may render him unable to work permanently. The WCB has received numerous orders that he is to attend specialized treatments in Edmonton or Camrose, and not to continue with their treatment schedule. Our family unit has suffered due to the stress that the WCB has placed on Ron as it aggravates his condition of RSD. They threaten to stop his pay if he doesn't attend THEIR schedule.

Rob Willis Calgary,Ab ; The soul-less members of the WCB, DRB, and Appeals Commission have obscured, ignored or neglected all pertinent evidence regarding my claim.....it's criminal and immoral.
The entire system should be scrapped.
The members should be prosecuted and incarcerated for crimes against humanity!

These are just some of the comments as this blog would be endless, but I hope there is enough here to make people aware of the abuse, manipulation and the deceit of the Workers Compensation Board of Alberta, along with criminal activities as fraud, manipulation of personal and medical information, intimidation and threats, physical, emotional and mental abuse just to name a few. Something must be done, our Government allows this to happen , WHY? cause they are there for the Corporations not for the people and when dealing like that, the Corporations become more corrupt and so does our Government.

How can WCB treat the injured fairly, when they will not enforce their own Act. WCB does not seem to understand the words:
statutory obligation,
as stipulated in the WCB Act.

They are allowed the power to govern themselves, from audits to policy, including enforcement of the act. The WCB has the choosing to do at their own discretion. The WCB along with Judicial Powers, enables them to be the Judge, Jury, Prosecutor, Witness and Server of Punishment;as they have total authority over the injured worker, the claim, Doctor and under certain circumstances your Lawyer. That happens when there is a 3rd party law suit, you must get WCB permission for a 3rd party law suit first; if you are able to succeed, then if any awards are granted; the award must be transferred from the court to WCB. The award is then subject to a 25% deduction and any legal costs that may have incurred will also be removed; AND you still have to pay your lawyer

I had terrible time proving my injury wasn't from a previous condition or whatever. I spent months in physio and was told to go back to work or I wouldn’t get paid. I ended up off my feet for two months and was mentally and physically exhausted so I let a union rep take on my case. WCB immediately denied my claim and my rep had to follow an appeal process. I was lucky to have this help and I don’t know how other people can do this on their own. I wish them all the best.
It is a must at this point to get a specialist on your side. My specialist agreed that the injury was totally in line with the physical circumstances and sent off a letter to WCB stating so. Within a week the WCB doctor accepted the findings. It seems that if your Dr. has a better education than the WCB’s Dr. it is pretty much a trump situation and they will not get into it with the Specialist.. It didn’t matter that the employer was cited for using deficient equipment or that my GP said the same thing as the specialist, it came down to having a Dr. with more credentials.

What a stupid bureaucratic system. I still haven’t got my bills paid. Been over a year since I was hurt.

The worker has to retain the right to sue the employer for contributory negligence. Some provinces are in agreement with this and it would send shivers down any employers back if he has to pay out of his own pocket.

I am currently on wcb and its appalling..
there are newer workplace laws against bullying at work...wcb employee's have them inplace to protect their workers and their service providers,
BUT
nothing in place to protect injured workers from the bullying and abusive wcb workers...NOTHING...and when most argue...thet are immeadiately threatend with no pay.
its a disgrace and against human rights legislation in alberta , but HR usually sides with wcb because of the way the laws were designed.

I'm in a similar situation with WCB. Can we, together, do something? As a group, perhaps there will be a loud enough voice to be heard. Perhaps, as a group, we can find the strength we need to continue the fight. I'm at the end of my rope...hopeless, depressed, jobless, and about to lose everything I worked so hard for. I’ve fought for years, tried my best to no avail. I’m tired and don’t know which way to turn. My lawyer has dropped me saying this is a no win situation…my employer has had me followed in an effort to disprove my injury…I’ve hired an advocate, but haven’t seen any results.
If there is an interest in pooling together our energies to fight this battle, contact me. I know none of us have any money, but, maybe we can get ourselves heard by someone, somewhere that can offer us help.

I suffered a brain injury due to negligence on behalf of my employer. Sadly one has no recourse because if your employer pays these parasites, you have no right to sue. You are cast in this demeaning play. Eventually you start believing you are as sub human as they are.

WCB had put me thru a retraining course, and had not even given me any notice that they were doing it. I had been in the electrical industry and oilfield, all of a sudden they put me through the TRANSCOM Dispatcher/supervisor course. This course is supposed to be nationally recognized, yet isn't heard of from any oilfield companies in or around the Grande Prairie area. They had put me through this course telling me it would make me more marketable...bullshit...they did it so their wage liability disappears...this wcb porcedure is a scam and they have to be brought to justice on their treatment of injured workers...im not disabled, but it is sept 2010, and i still have chemical burns and flaareups from jan 2010. I have yet been treated by this dermatologist that they keep telling me ill get to see, and my case manager debbie , left for a month for holidays....like wtf??? my family suffers with no money while they get paid to turn us down and take their bonuses and go on holidays while we sit and wait for their decisions???? Nice WCB....NICE
Your time will come and you will be weighed and judged, and then you will have some explaining to do...

It is abspulty amazing just what WCB can get away with.I have been on claim for over 10 years and was deemed by comp 2 years ago. Their latest tactic is to say that I do not need the amount of meds my gp has prescribed and are using past claims to justify this. They have tried to remove my home maintenince allowance but have not succeddeed yet they say I can work not one job but two so that they reduce the amount they have to pay out, yet documents and meds say I can not work(use due diligence here) . I am about to lose everything and still I can not catch a break. The system is broken and is taking all injured by occupation claimants to their graves at our own expense or that of our families, It is time this system is stopped and changed before one more worker loses thier battle.

WCB is nothing more than corporation that wants to only take in money but not pay out. I have been waiting for surgery on broken foot since November, 24,211. Today is Jan, 3, 2012 and I just came back from a private clinic that works for WCB. The doctor told me that I might not need surgery, in which I replied really doctor being sarcastic? I have to questions to ask and feel free to answer. If the doctors are not allowed to do surgeries on people because WCB does not want to pay, what is rights do employees have? Second question. If employees can’t find a lawyer who does WCB cases, what does the future hold and how can we the employees fight this machine?

Please email me if you know a lawyer who takes WCB cases thank you, I am in Calgary.

after being hurt may be for life.you have to fight this battle you never should of had to .because you think your covered by some kind of insurance.but that is not the case.they will keep denying it.it dont matter if you have all the eviadece.you wont win there to big.and they made me have 4 brakedowns.and i had to fight again 3 times to get cpp. used human rights

i to am also a victim of the employer got away with crippling me for life.Icant go after him for damages from a broken seat in a dumptrunk I even got a doctor persciption for seat,that added me getting cronic pain.I also had a fall caudht myself from falling.specialest said I got whiplash down my spine,and cronic pain.Iv already got a brain injury.iv been at it since 1991.IV GIVE UP!!!

Lucky One.... Belleive it or not, but I consider myself as very lucky one just because I was finally kicked out from WCB. A pice of equipment fail on my head casing my head injury. After almost 5 months and being 3 times re-injured at Millard health centre in Edmonton my "lovely" case manager kicked me off. I've learned that without new injuries from Millard's idiots I can hill myself much faster and be back to at least some kind of a job. Definetely WCB is such a mafia org. I was born in komunism country and can only tell you guys, some sheety organisation like this couldn't ever exist there. It seams that WCB stuff was trained in the worst .Soviet Union Jails. If I ever get injured again, I just knew this:"I'll refuse to go to Millard health centre for any rehab or assessment. I was dealing there with Neurologists and specialists who were telling me that:"No matter what my analises will show, they are going to write what my case manager is telling them to write, because they are paid by WCB, not by me or Alberta health......

WCB is a joker just like you guys i got injured at work in the hospital for working alone i kept telling my boss i cant handle the floor anymore boom one night bad thing happen to mg shoulder jan 2013 then april i went to back to work my hand got swollen and painful my doctor said is tendonities then by nov 2013 they put me back to work as a data entry but deep in my heart i knew is not suitable job for me after 2 weeks my hand its flaming in pain my doctor sain cp after that they cancel my benifit due is now work related because of all this cut off we become homeless for 8 months until now 2015 still denied im not sure how long this thinnng gonna be over.We should all of us do a petiton or fight for our right

The Alberta labor minister recently announced a panel to review WCB. It's been long overdue. How the Workers Compensation Act is interpreted and practiced by Alberta WCB is a great concern to patients and care providers. It is a concern that current practices of WCB are not in the spirit of the Act and the effectiveness and ethics of their practices are to be questioned. WCB’s practices has been far from providing appropriate treatments for injured workers and limited by design to minimize their financial responsibility.
